1. Acceptance of these terms
By accessing this website or making a donation through it, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the site or donate through it.
2. About the organisation
This website is operated by Partners Charity Fund For Israel, a nonprofit corporation exempt from United States federal income tax under section 501(c)(3) of the Internal Revenue Code, EIN 20-5550560, with its U.S. office at 5014 16th Ave., Apt 448, Brooklyn, NY 11204. The organisation also operates under the trading name “Partners” and, in Israel, as קופת הצדקה הכללית ביתר עילית.
3. Donations
- All donations are voluntary and are made in United States dollars (USD).
- Card donations are processed by Banquest. Your card statement will show the descriptor PARTNERS CHARITY FUND.
- No goods, services or benefits of any kind are provided in consideration of a donation.
- A donation is a completed gift once processed. It is not refundable except as set out in our Refund & Cancellation Policy, which forms part of these terms.
- If your card is issued outside the United States, your issuer may apply currency-conversion or foreign-transaction fees over which we have no control and for which we are not responsible.
4. Recurring donations
By choosing a monthly gift you authorise us, through our payment processor, to charge your chosen payment method the amount you selected on the same calendar day of each month, until you cancel.
- There is no minimum term, no notice period and no cancellation fee.
- You may change the amount, pause, or cancel at any time by emailing bepartners@gmail.com or telephoning 718-969-9705.
- We action cancellation requests within two business days and confirm them in writing. A cancellation stops all future charges; it does not automatically reverse charges already made, which are dealt with under the Refund Policy.
- If a recurring payment fails, our processor may retry it in accordance with its standard retry schedule. Repeated failure will suspend the recurring gift and we will contact you.
5. Use of funds
Undesignated donations are received into the general fund and allocated by our review committee to the areas of greatest need. Where you restrict a gift to a named programme we will honour that restriction. In the uncommon event that a restricted programme is already fully funded, we will contact you before applying your gift elsewhere.
The board of directors retains ultimate discretion over the application of all funds, as required of a charitable organisation under United States law.
6. Receipts and tax treatment
A written receipt is issued by email for every online donation, and a consolidated receipt for the prior tax year is sent each January. Donations are deductible for United States federal income tax purposes to the extent permitted by law.
We do not provide tax or legal advice. The deductibility of any gift depends on your individual circumstances. Please consult your own tax adviser.
7. Eligibility and accurate information
You must be at least eighteen years old and legally capable of entering into a binding agreement to donate through this website. You confirm that any payment method you use is yours or that you are authorised to use it, and that the information you provide is accurate and complete.
8. Acceptable use of this website
You agree not to:
- use this site for any unlawful purpose, including money laundering or the funding of unlawful activity;
- attempt to gain unauthorised access to any part of the site or its underlying systems;
- introduce malicious code, or interfere with the operation or availability of the site;
- use automated means to scrape, harvest or copy content from the site;
- impersonate any person, or misrepresent your affiliation with any person or organisation.
9. Intellectual property
All content on this website — text, design, layout, graphics, the Partners name and logo — is owned by Partners Charity Fund For Israel or used with permission, and is protected by copyright and trademark law. You may view, download and print pages for your own personal, non-commercial reference. Any other reproduction, distribution or use requires our prior written permission.
10. Third-party services and links
Payment processing is provided by Banquest under its own terms of service. This site links to third-party websites, including Banquest's hosted payment page and the IRS Tax Exempt Organization Search. We do not control those sites and are not responsible for their content, their availability, or their privacy practices.
11. Disclaimers
This website and its content are provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We take care to keep the information on this site accurate and current, including programme descriptions and financial figures, but we do not warrant that it is free of error or omission. Figures for a financial year are subject to final review and may be restated.
We do not warrant that the site will be uninterrupted, timely, secure or free of harmful components.
12. Limitation of liability
To the fullest extent permitted by applicable law, Partners Charity Fund For Israel, its directors, officers, volunteers and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or in connection with your use of this website or any donation made through it.
To the extent that liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to this website or any donation shall not exceed the amount of the donation to which the claim relates.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Partners Charity Fund For Israel, its directors, officers, volunteers and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these terms or your misuse of this website.
14. Governing law and disputes
These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or to this website shall be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to the personal jurisdiction of those courts.
15. Changes to these terms
We may revise these terms from time to time. The current version is always the one published on this page, and the date at the top reflects when it last changed. Your continued use of the site after a change takes effect constitutes acceptance of the revised terms. Changes do not apply retroactively to donations already made.
